Bankruptcy Can Free You From Worry

There are two kinds of bankruptcies that most consumers use. The "walk away from your bills" or "straight" bankruptcy is a Chapter 7 bankruptcy. It gets rid of your debt, so you can get a fresh start in life.

A "payment plan" bankruptcy, sometimes called a Chapter 13 case, is where you pay something to everyone that you owe, but not the full amount.

Which kind you file depends on whether you pass "the Means Test." This test calculates if you have enough extra money left over each month that you have to pay some toward your bills (see the chart at the right). If you earn less than the median income, then you qualify for a straight Ch. 7 bankruptcy. If not, then there is another test that we can use to see if you still qualify. Many people do.
